MELBOURNE: An employee who claimed her ADHD caused colleagues to misinterpret her actions or “scapegoat” her was not unfairly dismissed, according to the Fair Work Commission.
“An ADHD diagnosis, or feeling overstimulated, is not a licence to verbally abuse others at work without consequence,” Deputy President Nicholas Lake said.
Her comments were “not just off colour, they were threatening and disturbing”, he added.
Services Australia sacked the services officer in August last year, for failing to treat others with courtesy and respect, and displaying aggressive behaviour at work.
